This document ("Agreement") establishes the terms and conditions governing your use of the PetBook mobile application or any services offered by or through PetBook. By using this application, you accept these terms as legally binding and equivalent to a handwritten signature of acceptance.
PLEASE READ THESE TERMS CAREFULLY. BY USING PetBook, YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DISCONTINUE USE IMMEDIATELY.
1. Acceptance of Terms
Your access to and use of PetBook is subject to this Agreement. You may print a copy of these Terms for your records, and we highly recommend that you do so. Your use of the app constitutes acceptance of these Terms, which will remain effective until terminated by you or us in accordance with this Agreement.
2. Service Description and Limitations
PetBook is a pet care application that provides tools for pet management, such as health records, activity tracking, reminders, and VetAI—a feature offering general medical orientation for pets. While we strive to provide useful and accurate information, there are limitations to our services:
By using PetBook, you understand and agree that all information and features are provided "as is" and should not be solely relied upon for critical pet care decisions.
3. Eligibility and Age Restrictions
By using PetBook, you confirm that you are of legal age to enter into a binding agreement in your jurisdiction or have the consent of a parent or legal guardian if required by law. You are solely responsible for ensuring that you meet the legal requirements to use PetBook in your location.
4. Trial Period and Subscriptions
We may offer a free trial of the service, granting access to all features within a limited period. Subscriptions may be managed through the app store provider, and any payment disputes or refunds must be handled through that provider. PetBook reserves the right to modify subscription rates, introduce special promotions, or make changes to the service.
Billing and Refunds: PetBook operates on a subscription basis through App Store/Play Store and does not issue refunds. Billing adjustments, if needed, should be directed to the respective store provider.
Cancellation: You may cancel your subscription at any time via the app store provider. You remain responsible for all charges up to the date of cancellation.
5. Rights and License Grant
We grant you a limited, non-exclusive, non-sublicensable, and revocable license to access and use PetBook solely for its intended purpose. You may not collect, distribute, publicly display, or alter any part of PetBook or use any automated tools to access or manipulate the app. Any unauthorized use of PetBook may result in termination of this Agreement and potential legal consequences.
6. Modifications to Terms and Services
We may introduce new features or modify existing ones from time to time. Any substantial updates or revisions to these Terms will be posted within the app. Your continued use of PetBook after such updates will constitute acceptance of the revised Terms. If you do not agree with any modified terms, your sole recourse is to discontinue use of the app.
7. Limitation of Liability and Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
PetBook PROVIDES THE SERVICE "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We disclaim any liability for direct, indirect, incidental, or consequential damages arising from your use or inability to use the app. PetBook does not guarantee uninterrupted or error-free operation and cannot be held liable for issues arising from network disruptions, data delays, or any technical failures. You agree that your sole remedy for dissatisfaction with PetBook is to discontinue use of the app.
8. Privacy and Data Security
Your privacy is important to us. We handle your personal information in accordance with our Privacy Policy. Please review this policy to understand how we collect, use, and protect your data.
9. Intellectual Property and Copyrights
All trademarks, logos, and content within PetBook are the property of PetBook. Unauthorized reproduction, distribution, or modification of this content is prohibited.
In cases of alleged copyright infringement, PetBook will take necessary actions in line with applicable laws. If you believe that your intellectual property rights are being violated, please contact us at [email protected].
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the United States, and any disputes arising out of or relating to this Agreement shall be resolved exclusively in the courts of Florida. PetBook reserves the right to seek injunctive relief in any jurisdiction if deemed necessary.
11. Termination of Agreement
We reserve the right to terminate or suspend your access to PetBook for any violation of these Terms, misuse of the app, or any action that poses a legal risk to us or third parties. Upon termination, all rights granted to you under this Agreement will immediately cease, and you agree to discontinue use of PetBook. This Agreement will survive termination to the extent necessary to resolve any remaining obligations between the parties.
By continuing to use PetBook, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
